Attorney Stephen Madej Obtains Dismissal of Over $72,000 in Physical Therapy Claims

In a no-fault claim filed by the injured party, Attorney Stephen Madej obtained testimony from the treating physician of the injured party.  The treating physician also owned the physical therapy company providing services to the injured party.  The treating physician testified that he and his only employee were not licensed physical therapists or physical therapy assistants.  Moreover, he testified that the business had never employed a licensed physical therapist or licensed physical therapy assistant.  Following the testimony, Attorney Madej filed a Motion for Partial Summary Disposition arguing that the physical therapy company's claims were not compensable under MCL 500.3107b(c) because they were not provided by a physical therapist or a physical therapist assistant under the supervision of a physical therapist.  The Circuit Court agreed and granted the Motion for Partial Summary Disposition.  As a result, over $72,000.00 in claimed benefits were dismissed.
