In both cases, Mr. Smythe convinced the Court that the injured person's non-cooperation in refusing to submit to an Examination Under Oath, a subpoenaed deposition, and also refusing to execute authorizations violated Section 5.3 of the Michigan Assigned Claims Plan and prejudiced the servicing insurer's ability to investigate the claim and render a claims decision.
